  2. The Seller conducts commercial activity involving the sale of refrigeration equipment and shop fittings, both new and used.

2. Scope of These Terms

  1. These Terms define the rules for:
    1. using the Store,
    2. placing orders,
    3. concluding and performing sales agreements,
    4. payments and delivery,
    5. consumer withdrawal rights,
    6. warranty and complaints,
    7. processing personal data in connection with purchases (B2B and private customers).
  2. These Terms apply to:
    1. Consumers (natural persons not making purchases directly related to their business activity),
    2. Business customers (B2B).
  3. If mandatory consumer-protection laws provide broader rights than these Terms, such laws shall prevail.

4. Products Offered

  1. The Store sells new and used refrigeration equipment and shop fixtures, including but not limited to:
    1. shelving units,
    2. baskets,
    3. refrigerated counters and showcases,
    4. fridges, freezers, cooling devices,
    5. other equipment used in retail environments.
  2. Used items may show signs of prior use (scratches, dents, discoloration, wear). If such signs are disclosed in the product description, they do not constitute a defect.
  3. Product photos and descriptions are indicative. For used items, the Seller may provide photos of the exact item upon request.

5. User Accounts

  1. Customers may create a User Account in the Store’s WooCommerce system.
  2. Creating an Account is voluntary and free of charge.
  3. Account creation requires accepting:
    1. these Terms,
    2. the Privacy Policy,
    3. the Cookies Policy,
    4. the User Account Terms.
  4. Account functionality includes:
    1. order history,
    2. saved addresses,
    3. faster checkout,
    4. invoice data storage (including VAT/NIP for business customers).

6. Placing Orders

  1. Orders can be placed via:
    1. the product inquiry form,
    2. the WooCommerce shopping cart and checkout process.
  2. The customer must provide:
    1. personal or business details,
    2. delivery address,
    3. invoicing data,
    4. valid email address and phone number.
  3. Order submission requires:
    1. accepting these Terms,
    2. confirming the Privacy Policy and Cookies Policy.
  4. After placing an order, the customer receives an email confirmation.
  5. The sales agreement is concluded when the Seller confirms the order for processing.

7. Prices, Currencies and Payment

7.1 Currencies

  • Polish version → PLN
  • English / German versions → EUR

The currency chosen at checkout is binding for the transaction.

7.2 Prices

  1. Prices are gross (VAT included).
  2. Delivery costs are shown separately before finalizing the order.
  3. Price changes do not affect already confirmed orders.

7.3 Payment Method – Bank Transfer Only

Payment is accepted exclusively via bank transfer within 3 days.

The Seller issues VAT invoices.

8. Delivery

  1. Delivery areas:
    1. Poland,
    2. Germany,
    3. Austria,
    4. other EU countries (upon agreement).
  2. Estimated delivery time:
    1. Poland: 3–7 business days,
    2. Germany / Austria: 5–10 business days.
  3. Delivery includes transport to the building entrance only.
  4. The customer must inspect the shipment upon delivery. In case of visible damage:
    1. a damage report must be completed with the courier,
    2. photos should be taken if possible.
  5. Failure to prepare a damage report may limit the ability to pursue claims.

9. Right of Withdrawal

9.1 Consumers

  1. Consumers may withdraw from a distance contract within 14 days.
  2. Withdrawal must be reported via email: arkoolsztyn@gmail.com
  3. Returned items must:
    1. be complete,
    2. show no damage beyond normal inspection.
  4. Return shipping costs are borne by the customer.
  5. Refunds are issued within 14 days after receipt of the returned item.

9.2 Business Customers (B2B)

  1. No withdrawal right applies to business customers.
  2. B2B customers should carefully assess product suitability before ordering.

10. Warranty

  1. New equipment – covered by the manufacturer’s warranty.
  2. Used equipment – covered by a 30-day functional warranty unless stated otherwise.

The warranty does not cover:

  • mechanical damage after delivery,
  • improper installation or use,
  • normal wear and tear.

11. Complaints

  1. Complaints must be submitted via email: arkoolsztyn@gmail.com
  2. Complaints should include:
    1. customer details,
    2. order number,
    3. description of the issue,
    4. photos (if applicable).
  3. Complaints are processed within 14 days.
  4. Transport damage must be documented with a courier report.

12. Personal Data Protection

Personal data is processed in accordance with the Privacy Policy, Cookies Policy, and applicable laws including GDPR.

13. Cookies

The Store uses cookies for:

  • essential site operation (WooCommerce),
  • analytics (Google Analytics 4),
  • advertising (Meta Pixel, Google Ads),
  • functional preferences (language, currency).

14. Language Versions

The Store provides Terms in:

  • Polish,
  • English,
  • German.

If discrepancies arise, the Polish version prevails.

15. Final Provisions

  1. Polish law governs these Terms.
  2. The Seller may update the Terms due to legal or technical changes.
  3. Updates do not affect previously concluded agreements.
  4. These Terms enter into force upon publication.
